What is a settlement agreement?

A settlement agreement (also known as a compromise agreement) is a legally binding agreement between an employee and their employer. It can be used to either agree on the terms for ending employment, but also for changing the terms of the employment.

A settlement agreement may be used If the employment rights of the employee have been breached or are in question. The agreement usually includes a severance payment in return for an employee agreeing not to pursue any claims in a tribunal or court. The employer will usually outline the requirement for the terms and circumstances surrounding the agreement.

How much does a settlement agreement cost?

A settlement agreement is usually paid for by your employer. They will normally instruct you to seek independent legal advice about your settlement agreement. This is a legal requirement and if they fail to do this, the agreement may not be enforceable.
